Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the Novenas application for iOS and Android, its related website pages, content, and services (collectively, the "Service"). The Service is provided by Hatchi ("Hatchi", "we", "our", or "us"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

About Novenas

Novenas provides guided novena prayer content, reminders, progress tracking, and related features intended to support personal prayer and devotion. Some content or features may be available only with a paid subscription.

Eligibility and Accounts

You must be legally capable of agreeing to these Terms. If you are under the age of legal majority where you live, you may use the Service only with the permission and supervision of a parent or legal guardian. The Service is not directed to children under 13.

Some features require an account. You agree to provide accurate information and are responsible for:

• Keeping your sign-in credentials and devices secure
• Activity that occurs through your account
• Promptly notifying us if you suspect unauthorized access

Subscriptions, Trials, and Billing

Paid features may be offered through an auto-renewing subscription purchased from the Apple App Store or Google Play. The purchase screen will show the subscription benefits, price, billing period, and any trial or introductory offer before you confirm a purchase. Prices may vary by country and may include applicable taxes.

• Payment is charged to the Apple ID or Google Play account you use to complete the purchase.
• Unless stated otherwise at purchase, subscriptions renew automatically for the selected billing period until cancelled.
• You must cancel through the store where you subscribed. Deleting the app or your Novenas account does not automatically cancel a subscription.
• Cancellation generally takes effect at the end of the current paid period, so you may retain access until then.
• Trial eligibility and conversion to a paid subscription are governed by the offer shown at purchase. Cancel before the displayed trial deadline to avoid the next charge.
• Refunds, billing disputes, and price changes are handled under the policies of the applicable store and applicable law.

You can manage an Apple subscription in your Apple account's subscription settings, or manage an Android subscription in the Google Play subscription centre. If paid access is missing after purchase, use Restore Purchases in the app or contact us.

Prayer Content and Reminders

Novenas is a devotional aid and is not an official representative of, or substitute for, a church, parish, clergy member, spiritual adviser, or religious authority. Prayer text, translations, feast dates, traditions, and other religious material may differ between communities and sources. We aim to provide useful and respectful content, but do not guarantee that all content is complete, error-free, or appropriate for every tradition. Reminders are a convenience only and may be delayed or not delivered because of device settings, connectivity, platform restrictions, or service interruptions.

Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, abusive, or harmful purposes
• Access another person's account or data without permission
• Interfere with the security, operation, or availability of the Service
• Introduce malicious code or attempt to bypass access or subscription controls
• Scrape, copy, redistribute, sell, reverse engineer, or commercially exploit the Service or its content except where applicable law expressly permits it
• Misrepresent your identity or your affiliation with Hatchi or Novenas

Intellectual Property

The Service, including its software, design, branding, arrangement, and original content, is owned by Hatchi or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service on devices you own or control for personal, non-commercial purposes. No ownership rights are transferred to you. Rights in third-party or public-domain materials remain with their respective owners.

Third-Party Services

Novenas may rely on services such as Apple Sign In, Google Sign-In, Firebase, RevenueCat, Sentry, Apple's App Store, and Google Play. Your use of those services may also be governed by their own terms and policies. We do not control and are not responsible for third-party services, except to the extent required by law.

Privacy and Account Deletion

Our Privacy Policy explains how we collect, use, and safeguard information. You may request deletion using our account deletion page. Account deletion does not cancel an active App Store or Google Play subscription.

Service Availability and Changes

We may maintain, update, modify, suspend, or discontinue parts of the Service. We do not promise that the Service, any particular novena, or any feature will always be available, uninterrupted, secure, or error-free. Where reasonably possible, we will provide notice of material changes that significantly affect paid features.

Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes, restricts, or modifies a consumer guarantee, right, or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law where applicable.

Limitation of Liability

To the maximum extent permitted by law, Hatchi and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profits, goodwill, or opportunities arising from or related to the Service. This limitation does not apply to liability that cannot lawfully be limited or excluded.

Suspension and Termination

You may stop using Novenas at any time. We may suspend or terminate access if you materially breach these Terms, create legal or security risk, or harm the Service, Hatchi, or others. On termination, your licence to use the Service ends. Provisions that by their nature should survive termination will remain in effect.

Apple-Specific Terms

If you downloaded Novenas from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Hatchi, not Apple.
• Hatchi, not Apple, is solely responsible for Novenas and its content.
• Apple has no obligation to provide maintenance or support services for Novenas. Contact Hatchi using the details below for support.
• To the extent any warranty exists and Novenas fails to conform to it, you may notify Apple and Apple may refund the purchase price, if any, as required by its policies and applicable law. To the maximum extent permitted by law, Apple has no other warranty obligation for Novenas.
• Hatchi, not Apple, is responsible for addressing claims relating to Novenas, including product liability, legal or regulatory compliance, and consumer-protection claims.
• Hatchi, not Apple, is responsible for investigating and resolving claims that Novenas infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government restricted-party list.
• You must comply with applicable third-party terms when using Novenas.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

Google Play-Specific Terms

If you downloaded Novenas from Google Play, these Terms are between you and Hatchi, not Google. Hatchi, not Google, is responsible for Novenas and for providing support. Your use of Google Play and purchases made through it are also subject to the Google Play terms and policies. Google is not responsible for obligations under these Terms except as required by applicable law.

Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law principles. Courts located in Victoria will have non-exclusive jurisdiction. This clause does not limit any mandatory consumer right or your right to bring a claim in another forum where applicable law permits it.

Changes to These Terms

We may update these Terms from time to time. We will provide reasonable notice of material changes through the Service or by posting the revised Terms here. The "Last updated" date shows when they were most recently revised. If you continue to use the Service after revised Terms take effect, you agree to the revised Terms.
